13. IMPLEMENTATION / SANCTIONS

From Own Resources:

13.1. The violation of this Policy established in all the previous paragraphs of this Code of Ethics and Conduct, the Internal Procedures or the applicable regulations, make NUCTECH COMPANY LTD Personnel directly responsible. These violations will be considered a very serious offense to labor obligations, which according to the circumstances may give rise to sanctions. The applicable sanctions will be legally admissible disciplinary measures according to art. 67 of Law 20,744, applicable according to the seriousness of the offense committed, fulfilling the three essential requirements: contemporaneity, proportionality and non-duplication of sanctions. The sanctions will be communicated in a reliable way by a signed note to the worker, telegram or document letter expressing the cause of the sanction clearly, determining the facts that motivated it and the date on which they occurred. And giving the worker the possibility of legitimate defense, as clearly emerges from the second paragraph of art. 67 of the LCT, which provides that “within thirty calendar days of the notification of the measure, the worker may question its origin and the type or extension of the same, so that it is suppressed, replaced by another or limited according to the cases . Once said term has expired, the disciplinary sanction will be considered consented ”.
13.2. The sanctions are: the warning, the suspensions (between 1 and 30 days in a year) and the dismissal for just cause. The so-called “wake-up call” or the simple verbal warning does not constitute a proper disciplinary sanction.

Of the Relationship with Third Parties:
13.3. Compliance with the provisions of this Code by the Third Party is an essential condition for maintaining the commercial relationship with NUCTECH COMPANY LTD. 13.4. Failure to comply with the obligations assumed will be considered a serious fault and will enable NUCTECH COMPANY LTD. ARGENTINA BRANCH empowered to decide to initiate actions for non-compliance and for damages that may have been caused, without prejudice to the application of the corresponding penalties and / or; (c) eliminate the Third Party from the “Registry of Suppliers”.
